It can happen to anyone! Here is a little story about Robert K. Wittman, the founder of the FBI's Art Crime Team. In his fascinating book, "Priceless" Mr. Wittman tells a tale his own heart wrenching experience, not as a law enforcement professional, but as defendant in a manslaughter case aimed at him while he was a Special Agent with the FBI.
The long and the short of it is this. He and his partner were in a car. They had been at a celebration and he was sober and acting as the designated driver to take his overindulgent partner home. In the course of driving Robert was startled by a bright light and lost control of the car. He and his partner were both removed from the wreck with the jaws of life and taken to the hospital where he survived and his partner died of a burst aorta.
In the hospital there was no chain of evidence procedure in place and Robert's blood alcohol sample was mixed up with the one from his intoxicated partner which was way over the limit for DUI. Robert was facing loss of career, family, credibility, and freedom. He got a good criminal defense attorney with a great investigator and after a NINE day trial he was found not-guilty and acquitted of the charge of manslaughter.
Here's the rub and this is what I am blogging about. Shortly before his trial a prosecutor made the offhand remark to him that the prosecution knew their case was weak, "but we have to lose at trial".
