The Challenge
Following an aerial surveillance operation and a search warrant at a five-acre property, a mother was arrested and charged with large-scale marijuana cultivation, possession for sale, and felony child endangerment. With over 320 pounds of processed marijuana and 175 plants found on-site, the client faced significant prison time and the potential loss of parental rights due to the endangerment charges.
Our Strategy
We spent two years challenging the prosecution’s evidence, specifically disputing the link between the cultivation operation and the alleged endangerment of the children. Through persistent negotiation, we convinced the District Attorney to dismiss the possession for sale and child endangerment charges. The case was resolved with one year of misdemeanor probation and parenting counseling, protecting the client from a felony conviction and keeping the family together.
The Result
FELONY CHARGES DISMISSED; MISDEMEANOR RESOLUTION
