The Challenge
An active-duty member of the Armed Forces was arrested and charged with felony domestic violence. For an enlisted service member, a felony conviction—or any domestic violence conviction—would have led to a mandatory discharge from the military and the permanent loss of the right to possess a firearm, effectively ending his career.
Our Strategy
Our defense focused on the credibility of the complaining witness. We conducted an investigation into the witness’s background and secured evidence demonstrating a documented history of making similar false accusations. By presenting this evidence to the prosecution before the case progressed further, we established that the allegations lacked the necessary foundation for trial. Based on the strength of our findings, the prosecutor dismissed the case in its entirety.
