The Challenge

A retired Lieutenant Commander in the U.S. Navy faced federal charges for felony receipt of child pornography, an offense that typically carries substantial prison sentences under federal sentencing guidelines. Given the nature of the charges and the applicable guidelines, our client was facing the prospect of a significantly longer federal prison term.

Our Strategy

Through extensive sentencing advocacy, we presented mitigating evidence regarding our client’s background, military service, and personal circumstances, arguing that a substantially reduced sentence was warranted. The court ultimately imposed a sentence of only two years in federal prison, a result far below the standard federal sentencing guidelines for this type of offense. The sentence was so significantly reduced that the U.S. Attorney’s Office filed an appeal challenging the judge’s decision.
