Lewd Act & Sexual Battery Charges Dismissed for CHP Officer

The Challenge

A California Highway Patrol (CHP) officer was accused of committing a lewd act and sexual battery involving a teenage neighbor while off-duty. Given the nature of the allegations and the client’s role as a state peace officer, a conviction would have resulted in mandatory sex offender registration, a jail sentence, and the immediate termination of his career and law enforcement credentials.

Our Strategy

We proceeded to a jury trial to aggressively challenge the prosecution’s evidence and the credibility of the accusations. After a full presentation of the facts and cross-examination of the witnesses, the trial resulted in a hung jury. Following the trial, the prosecutor dismissed all charges.
