Homeowner Detains Suspect at Gunpoint During Botched Residential Burglary. Temecula, Murrieta and Hemet Defense Attorney

Riverside Police are currently investigating a burglary, which allegedly occurred Friday, June 13th.

According to The Riverside Press Enterprise, the botched burglary occurred on the 6500 block of Marlo Way in an upscale neighborhood in broad daylight.

The alleged plot was foiled however, when the owner of the home was able to restrain one of the attempted burglary suspects at gunpoint. A Riverside Police Department spokesperson told local reporters that the incident happened around 2:15 p.m.

The homeowner told police he came home that afternoon to find four people burglarizing his house. The suspects are described as two juveniles, one adult, and a fourth unidentified person, according to the spokesperson.

Officers were able to catch two of the suspects soon after the incident using units on the ground and by helicopter. Police have confirmed that the homeowner acted lawfully with the use of his weapon. By Wednesday (June 18), Press Enterprise reporters could not confirm if the fourth suspect was apprehended.

According to the California Penal Code the crime of burglary is classified as follows:

Every person who enters a house, room, apartment, tenement, shop, warehouse, store, mill, stable, outhouse, or other building with the intent to commit petty larceny or any felony is guilty of burglary. (California Penal Code, Section 459).

In California, burglary is prosecuted at two severity levels, which are first and second-degree. Second-degree burglary is charged when a suspect is accused of unlawfully entering a place of business with the intent to steal merchandize. Burglary in the first-degree is charged when a suspect is accused of unlawfully entering a home while it is inhabited.

Both of these scenarios can land a substantial amount of jail or prison time for a defendant who is found guilty on burglary charges.
